A dispute between PepsiCo and a small energy-drink bottler over a distribution deal is headed to court.

VPX Sports, the maker of Bang Energy, issued a statement Nov. 25 declaring that it is suing PepsiCo over a distribution deal that the two companies reached in April. The statement did not specify where or in what court VPX Sports’ lawsuit was filed.

The agreement specifies PepsiCo as the exclusive nationwide distributor of Bang Energy through October 2023. But in the statement, VPX Sports declares that the deal is no longer valid and charges that PepsiCo “has resorted to intimidation tactics with independent distributors and major retailers like Walmart threatening lawsuits against anyone who fails to purchase Bang Energy exclusively from Pepsi.”

VPX Sports CEO Jack Owoc says in the statement that he was “blindsided and bamboozled” in the PepsiCo deal. However, the statement doesn’t specify on what grounds VPX is seeking to nullify the contract.
